This Policy sets out the approach the
Express Chauffeured Coaches and Limousines (ECC)
has adopted in its collection and management of personal information. ECC
has created this Privacy Policy to demonstrate and confirm its commitment to
your Privacy.
This Policy relates to personal and sensitive information collected by any
means by ECC.
1. Background
ECC is committed to providing the highest levels of customer
service and respects the right of individuals to maintain their Privacy.
New Privacy laws took effect on 21 December 2001. From that date, newly
acquired personal and sensitive information obtained by ECC or
modification of personal and sensitive information already held is subject
to the Privacy Act 1988 (the Act) and the National Principles for the Fair
Handling of Personal Information (NPPs).
2. Aims of the Privacy Policy
ECC wants to help people understand the reasons behind, and actions taken
in, the protection of personal information and will be fair and open about
the process.
ECC respects the individual’s right to privacy and is committed
to ensuring that the collection, accuracy, storage, use, disclosure,
de-identification and destruction of personal information is compliant with
the Privacy Act 1988, incorporating the Privacy Amendment (Private Sector)
2000, best practice and the NPPs.
ECC will ensure that its employees receive training in the proper handling
of personal information. Access to information held by us will be limited to
authorised people on a strict, need-to-know basis relevant to their roles
and responsibilities.
3. How and Why ECC collects Personal
Information? Often times, personal information is gathered in order to improve service
levels to customers. Personal information is information or an opinion,
including information or an opinion forming part of a database, whether true
or not, and whether recorded in a material form or not, about an individual
whose identity is apparent, or can be reasonably ascertained, from the
information or opinion.
Personal information is essentially collected through the
Booking
Request, Quotation Request and Contact Us forms. The personal information
ECC collects
may include:
ECC strives to ensure that the information collected is accurate at the
time of collection and at the time of use.
4. Use and Disclosure of Information ECC collects and uses information for the primary purpose of managing
customers' travel arrangements. ECC may use information that has been
collected to enable the highest possible level of service to be provided.
Data collected is used solely for transport
management purposes and is not passed or sold to any third party, with two
exceptions.
On the days prior to your arrival and
departure we send a Booking Confirmation form to the accommodation
house where you are staying to let them know that your travel arrangements
are in hand. This is a double check to ensure that your requirements
will be met.
If, for some reason (eg ECC vehicle delays
due to road conditions, accidents, mechanical failure) we have to pass
your travel requirement to another transport company we will need to pass
to them the name of your party, your flight details, and your pickup point
and destination.
ECC may disclose your information to:
• Your authorised representatives (eg legal advisers) but only upon receipt
of your written authorisation; • Professional advisers including but not limited to accountants, auditors
and legal advisers; and • Courts, Government and regulatory authorities as required or authorised by
law.
5. On-line Collection
ECC collects information from its website to assist with website and
system administration. The ECC website automatically collects the
following information:
• Server address; • Top level domain name (eg - .gov, .com etc);
• Date/Time of visit; • Pages accessed; • Pages Downloaded;
• Total time spent on the website and the browser used; and • Time spent on individual pages.
ECC does not collect email addresses or personal information from
computers accessing our website. ECC collects email addresses only when
you send us a message.
This information is only used for the purpose of responding to your request, and is not passed on to any other organisation.
It is not mandatory for visitors to this website to provide personal
information unless the information is necessary for us to be able to answer an enquiry, a
complaint or to provide a service. Personal information collected on-line will not be sold to
third parties or made available for other than the purposes listed above.
The ECC website sets ‘cookies’ that remind visitors to read and accept the
site Use Agreement. The ‘cookies’ do not record or relay any information.
The ‘cookies’ expire after 24 hours.
ECC does not provide facilities for the secure transmission of data across
the Internet. You should be aware that there are inherent risks in
transmitting any data across the Internet or by email.
By using the ECC website you acknowledge that have read, understood and
agreed to abide by the Privacy Policy.
ECC website may contain links to other sites for your convenience and
information. When you access any websites other than www.eccportdouglas.com please
understand that ECC is not responsible for the Privacy policies and
practices of those sites. We suggest you review the Privacy policies of each
site that you visit.
6. Access
Please note that the personal information that ECC holds about you is
information that you have provided to us.
If you wish to exercise your right under the Privacy Act to seek access to
the personal information held by ECC about you, or if you believe that the
information is incorrect, incomplete or out-of-date, you should contact
ECC.
All requests to access personal information must be made in writing or by
email and addressed to the Privacy Officer at the addresses listed at the
end of this document.
It will assist ECC if you are able to specify the information you are
seeking, the approximate date that you provided the information and in what
context you provided it. It is ECC policy to respond to any such requests
within a reasonable timeframe.
ECC will generally not charge you for making requests to access any
information held about you, however, ECC reserves the right to undertake
cost recovery for the provision of such information where it is justified.
7. Information Security
The physical and electronic security systems operated by ECC comply with
the Privacy Act and the NPPs.
Personal information will be de-identified or destroyed when it is no longer
required. The de-identification and destruction process will be in
accordance with the legislation and the NPPs.
ECC will review, on a regular and on-going basis, its information security
and handling procedures to ensure the fulfilment of our obligations in
accordance with the Privacy legislation.
ECC personnel and third party contractors, who have a genuine
‘need-to-know’, are permitted to access personal information.
8. Complaints & Enquiries
All requests to access personal information must be made in writing or by
email and addressed to the Privacy Officer.
If you have a complaint regarding the Corporation's management of your
personal information or wish to correct information held by us or wish
further information please contact us.
Information about the Privacy Act and the National Principles for the Fair
Handling of Personal Information is available from the Federal Privacy
Commissioner.
